Terms & Conditions - Q2 2025

1. Acceptance of Terms
By accessing or using the Diamante SAAS platform (“Service”), you (“User,” “You”) agree to be bound by these Terms & Conditions (“Terms”). If you do not agree, you may not use the Service. These Terms form a legally binding agreement between you and Diamante SAAS (“Company,” “We,” “Our”).

2. Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use the Service. By using the Service, you represent and warrant that you meet these requirements.

3. Services Provided

Diamante SAAS provides a suite of secure and automated software tools, including but not limited to:

  • Digital Wallet and Smart Savings

  • Gift Card and Exchange functionality

  • Automated server infrastructure

  • Security features including two-factor authentication, data encryption, and text alerts

We reserve the right to modify, enhance, or discontinue parts of the Service at any time without prior notice.

4. Accounts and Security

Users may be required to create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. You agree to notify us immediately of any unauthorized use or breach of security.

5. Payments and Fees

If applicable, you agree to pay all fees associated with your use of the Service in accordance with the pricing and billing policies set by the Company. Payments are non-refundable except as required by law.

6. Intellectual Property

All content, technology, designs, and materials within the Service are owned or licensed by the Company. You are granted a limited, non-exclusive, non-transferable license to use the Service solely for its intended purpose. You may not reproduce, distribute, or create derivative works without written consent.

7. Acceptable Use

You agree not to use the Service to:

  • Engage in unlawful, fraudulent, or harmful activities

  • Interfere with the security or functionality of the platform

  • Upload or transmit malicious code or content

  • Violate the rights of others, including intellectual property and privacy rights
     

8. Data and Privacy

We collect and process personal data in accordance with our Privacy Policy. By using the Service, you consent to such processing.

9. Disclaimers and Limitation of Liability

The Service is provided “as is” and “as available,” without warranties of any kind. To the maximum extent permitted by law, the Company disclaims all liability for damages, including but not limited to loss of profits, data, or business opportunities arising from use of the Service.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or if required by law. Upon termination, your right to use the Service will cease immediately.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Insert State/Country], without regard to conflict of law provisions. Any disputes shall be resolved in the courts of that jurisdiction.

12. Changes to Terms

Continued use of the Service after changes constitutes acceptance of the revised Terms.
